SUMMARY OF BILL:    Clarifies that a public charter school authorized in its charter 
agreement to locate in a county local education agency (LEA) is not allowed to charge a student who 
resides in the county any registration fees, enrollment fees, or tuition if the student transfers to the 
public charter school from another LEA located in the same county. 
 
 
FISCAL IMPACT:

 Assumptions: 
 
• Pursuant to Tenn. Code Ann. § 49-13-113(c)(3), tuition and fees may be charged by the 
LEA in which the public charter school is located and to which a student transfers. 
• Pursuant to Tenn. Code Ann. § 49-13-106(e)(1), a public charter school may not charge 
registration fees, enrollment fees, or tuition unless the governing body of the public charter 
school approves a student's transfer from another LEA to the public charter school. 
• The proposed legislation clarifies that public charter schools located in a county LEA may 
not charge a student who resides in the county any registration fees, enrollment fees, or 
tuition if the student transfers to the public charter school from another LEA located in the 
same county. 
• Public charter schools will be able to update their tuition policies within existing resources. 
• For any public charter school charging tuition to students that is not in accordance with the 
proposed legislation, those public charter schools will be required to stop charging tuition 
to applicable students.  
• It is assumed that any reduction in tuition revenue for a public charter school will be 
minimal.
