FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 8-47-102, the Attorney General and Reporter (AG) has the power, on the AG’s own initiative, and without any complaint having been made to the AG or request made of the AG, to institute proceedings in ouster against any and all state, county, and municipal officers, under this chapter, and the DAG, county attorneys, and city attorneys, within their respective jurisdictions, may institute such actions, without complaint being made to them or request made of them, as they are authorized to institute upon request made of them or complaint made to them. • The proposed legislation authorizes the DAG to specially appoint another DAG or an ADAG to conduct proceedings related to the removal of officers. • Authorizing a DAG to specially appoint a DAG in another district to conduct certain proceedings will not result in any significant fiscal impact to state or local government expenditures. • Any fiscal impact to state or local government is estimated to be not significant.
