SUMMARY OF BILL:    Establishes that an attorney who, while acting in the capacity of 
counsel for a client or an identifiable prospective client, that engages in conduct that constitutes the 
following offenses is not immune from prosecution: (1) perjury; (2) aggravated perjury; (3) 
subornation of perjury; (4) tampering with or fabricating evidence; (5) destruction of or tampering 
with governmental records; or (6) coercion or persuasion of a witness. 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT 
  
 Assumptions: 
 
• There is no state law that provides immunity from prosecution for attorneys for the 
offenses outlined in the proposed legislation. 
• There will not be a sufficient change in the number of prosecutions for state or local 
government to experience any significant change in revenue or expenditures.  
• Any impact to the court system as a result of the proposed legislation is estimated to be not 
significant.
