SUMMARY OF BILL:    Increases the maximum fine, from $50 to $500, for the offense of 
selling a vapor product to a person below 21 years of age. 
 
 
FISCAL IMPACT:

 Assumptions: 
 
• Pursuant to Tenn. Code Ann. § 39-17-1504(a), it is unlawful for any person to sell or 
distribute any tobacco, smoking hemp, vapor product, or smokeless nicotine product to 
another person who has not attained 21 years of age, or to purchase a tobacco, smoking 
hemp, vapor product, or smokeless nicotine product on behalf of such person under 21 
years of age. 
• Pursuant to Tenn. Code Ann. § 39-17-1510, a violation of such is a Class C misdemeanor. 
• Pursuant to Tenn. Code Ann. § 40-35-111(e)(3), a Class C misdemeanor is punishable by no 
more than 30 days of imprisonment and a fine not to exceed $50, or both. 
• The proposed legislation increases the maximum allowable fine from $50 to $500. 
• Based on the Fiscal Review Committee’s 2008 study and the Administrative Office of the 
Courts’ 2012 study on collection of court costs, fees, and fines, collection in criminal cases 
is insignificant. The proposed legislation will not significantly impact state or local revenue. 
• There is not expected to be a change in the number of convictions or the time spent in local 
jails by such offenders.  
• Any fiscal impact to local government is estimated to be not significant.
