SB 1013 - HB 1069 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 21, 2025 Fiscal Analyst: Justin Billingsley | Email: justin.billingsley@capitol.tn.gov | Phone: 615-741-2564 SB 1013 - HB 1069 SUMMARY OF BILL: Prohibits any homeowner’s association (HOA) from restricting the operation of a proposed family child care home that has obtained the necessary licensure from the Department of Human Services (DHS) and any necessary permits or licenses from local government agencies. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The proposed legislation makes void and unenforceable a restriction on the operation of a family child care home that may be in an HOA’s declaration, if a proposed family child care home obtains necessary licensure from DHS and necessary local permits or licenses. • It is not known how many HOAs currently restrict the operation of a child care home within the jurisdiction of the HOA. • It is not expected that the proposed legislation will result in an increase in the number of licensed family child care homes in the state sufficient enough to significantly impact DHS operations. • The proposed legislation will have no significant impact on state or local government. IMPACT TO COMMERCE: NOT SIGNIFICANT Assumptions: • The proposed legislation will not significantly impact commerce or jobs in this state. CERTIFICATION: The information contained herein is true and correct to the best of my knowledge. Bojan Savic, Executive Director
