SUMMARY OF BILL: Prohibits the Department of Environment and Conservation
(TDEC) from applying criteria that will result in the classification of real property as a wetland,
where such property is classified as Prior Converted Cropland (PCC) that is exempt from
classification as a wetland under federal law.
FISCAL IMPACT:
NOT SIGNIFICANT
Assumptions:
• Based on information previously provided by the TDEC, under the federal Clean Water Act,
land classified as PCC is exempt from federal wetland permitting requirements for a period
of five years after agricultural production ceases on such land.
• This legislation will have no impact on the TDEC’s ability to collect or receive revenue, or
on programs or personnel of the Department.
• This legislation is estimated to have no significant fiscal impact on state or local
government.
