Allows a state inmate adversely affected by a decision of the Department of Correction (DOC) as it relates to the dissemination of printed materials to petition the department for a hearing. Authorizes a correctional institution deny dissemination and return the printed materials to its sender if the institution can establish by clear evidence that the materials are a threat to the security of the institution. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The proposed legislation prohibits a correctional institution from denying the dissemination of printed materials from book vendors to inmates, unless the institution can establish by clear evidence that the materials are a threat to the security of the institution. • DOC can receive, review, and disseminate any printed materials it receives from book vendors within existing resources. • Any additional hearings that arise under the proposed legislation can be accommodated within existing resources. • The proposed legislation will not significantly impact state or local government operations. • Any fiscal impact will be not significant.
