SUMMARY OF BILL:    Makes various changes to the rules and regulations related to 
insurance companies. Requires a health benefit plan issuer to, within 30 days upon request, provide a 
claims experience report to a plan, plan sponsor, or administrator of an Employee Retirement Income and 
Security Act of 1974 (ERISA) group health plan. Establishes information that must be included in 
such reports. Establishes that a plan, plan sponsor, or plan administrator may use information in 
such reports only as necessary to perform treatment, payment, or health care operations, as those 
terms are described by the HIPPA Privacy Rule.  
 
Makes various changes relative to a certified reinsurer’s jurisdiction and reciprocal jurisdiction. 
Effective January 1, 2026, revises the definition of personal risk insurance in relation to farms. 
Makes various changes to provisions relating to the readability, content, and style of life and health 
insurance policies. 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT 
 
 Assumptions: 
 
• The proposed legislation will not have a significant impact to the Department of Commerce 
and Insurance; any updates to the rules and regulations can be accomplished within existing 
resources. 
• According to information provided by the Division of TennCare, the provisions of the 
legislation will not have a significant impact to health insurance coverage provided by 
TennCare. 
• According to information provided by the Division of Benefits Administration, passage of 
the proposed legislation will have no impact to the State Group Insurance Program health 
plan. 
• Any fiscal impact to state or local government is estimated to be not significant.
