SUMMARY OF BILL:    Establishes a process by which the governing body of an existing 
public charter school may replicate that public charter school in the same district by applying to the 
local board of education or directly to the Tennessee Public Charter School Commission 
(Commission).  
 
Authorizes in certain circumstances, a public charter school sponsor to apply directly to the 
Commission to open a new public charter school rather than the local board of education. 
Authorizes a public institution of higher education in this state that seeks to open a public charter 
school to apply to the local board of education or directly to the Commission.  
 
Transfers various responsibilities among the State Board of Education (SBE), the Commission, and 
the Department of Education (DOE) pursuant to public charter schools. Creates certain reporting 
requirements and establishes processes for the approval and length of certain public charter school 
agreements.

 Assumptions: 
 
• The proposed legislation establishes a replication process for public charter schools and 
authorizes a governing body that has at least one public charter school authorized by a local 
board of education or by the Commission that has been in operation for at least one full 
school year to apply for replication in the local education agency (LEA) in which the 
governing body is currently operating to the local board of education or directly to the 
Commission. 
• Additionally, this legislation establishes circumstances in which a public charter school 
sponsor may apply directly to the Commission. 
• It is assumed that the proposed legislation will not result in a significant change in the 
number of public charter school applications in the state. Any increase in administrative 
burden to the Commission or to local boards of education will be absorbed utilizing 
existing staff and resources, without an increase in expenditures. 
• The proposed legislation transfers responsibilities pertaining to public charter schools 
among the SBE, Commission, and DOE. Any increase in administrative duties can be 
handled through existing workstreams without an increase in state expenditures.

• The Commission, SBE, DOE, and LEAs will be able to comply with the proposed 
legislation within existing resources such that any fiscal impact is estimated to be not 
significant.
