SUMMARY OF BILL:    Requires the Department of Safety (DOS) to submit a report to the 
Governor, the Speaker of the Senate, and the Speaker of the House of Representatives by February 
1 of each year that provides the number of individuals statewide and in each county that were 
convicted for the commission of a violent crime, or for an offense that involved the display of a 
deadly weapon, and the statutory penalty was enhanced because the defendant was an illegal alien. 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT 
  
 Assumptions: 
 
• Pursuant to Tenn. Code Ann. § 40-35-325(b), a court may enhance the statutory penalty up 
to imprisonment for life without the possibility of parole for a conviction under the 
following circumstances: 
o The conviction is for the commission of a violent crime and the defendant was an 
illegal alien at the time the offense was committed; or, 
o The conviction involves the use or display of a deadly weapon and the defendant 
was an illegal alien at the time the offense was committed.   
• Pursuant to Tenn. Code Ann. § 40-35-325(c), an arrest and subsequent conviction for 
which such enhancement factors would apply must be reported to the DOS.  
• Based on information provided by the DOS, it is assumed the department can compile and 
submit the annual report within existing resources. 
• Any fiscal impact to state or local government is therefore estimated to be not significant.
