SUMMARY OF BILL:    Requires a person to complete a course of instruction concerning 
online notarization and pass the examination administered by the course provider in order to qualify 
to be commissioned as an online notary public. Specifies that the course of instruction be approved 
by the Secretary of State (SOS) or their authorized representative or designee. Effective January 1, 
2026. 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT  
  
 Assumptions: 
 
• Pursuant to the proposed legislation, the course of instruction on online notarization must 
include notarial laws, technology procedures of online notarizations, and ethical 
requirements for online notaries. 
• The cost of completion and passage of an online course will be borne by private parties to 
private parties. 
• The proposed legislation will not result in any significant change in the number of 
individuals who seek commission as an online notary public; therefore, the will be no 
subsequent change in the revenue associated with the initial application fee. 
• The SOS, or their authorized representative or designee, can approve courses of instruction 
by utilizing existing staff and resources and without any significant fiscal impact.
