FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 39-15-411, a person who disseminates smoking paraphernalia shall prominently display in the place where the items are disseminated, either the sign required by the Prevention of Youth Access to Tobacco, Smoking Hemp, and Vapor Products Act, or the sign required prior to April 22, 1994. A violation of this law is a Class C misdemeanor. • The proposed legislation removes the authorization to use the sign required prior to April 22, 1994. • The proposed legislation does not expand the criminal offense; therefore, there is not expected to be a significant change in the number of convictions. • Any costs related to signage replacements will be borne by private parties. • Any fiscal impact to local government is estimated to be not significant.
