Extends certain requirements regarding public accessibility of a state or local governing body’s agenda to apply to the governing body of certain nonprofit companies, not-for-profit companies, and organizations. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Tennessee Code Annotated § 8-44-102(b)(1) defines a governing body as: o The members of a public body which consists of two or more members with the authority to make decisions for or recommendations to a public body; and o The board of directors of certain nonprofit companies, not-for-profit companies, and organizations. • Pursuant to Tenn. Code Ann. § 8-44-110(d), a state governing body or a local government legislative body which maintains a website is authorized to make an agenda available to the public through its website. • This legislation would require all governing bodies that maintain a website to post such agenda on their website. • It is assumed that such governing bodies can post their agendas on their websites utilizing existing staff during normal working hours, resulting in no significant impact to state or local government expenditures. • Requiring certain nonprofit companies, not-for-profit companies, and organizations to make meeting agendas available to the public will have no fiscal impact on state or local government.
