SUMMARY OF BILL:    Requires a family life curriculum to include instruction to students in 
grades nine through twelve (9-12) on this state’s Safe Haven Law.  Requires the state board of 
education (SBE) to develop guidelines for the required instruction. Requires the Department of 
Education (DOE) to develop educational materials aligned to the guidelines developed by the SBE 
and to distribute the guidelines to each local education agency (LEA) that serves students in any of 
the grades 9-12 and to each public charter high school before the start of the 2025-26 school year.

 Assumptions: 
 
• Pursuant to Tenn. Code Ann. § 49-6-1302(a)(2), each local education agency is required to 
locally develop and adopt a family life curriculum that conforms with statutory guidelines.   
• Tennessee Code Annotated § 49-6-1304 outlines the topics for a family life curriculum that 
may be taught to the extent the topic and manner of communication is age appropriate. 
• The proposed legislation requires a family life curriculum to provide instruction to students 
in any of the grades 9-12 on the protections established in Tenn. Code Ann. §§ 36-1-142 
and 68-11-255 for the voluntary surrender of an unharmed infant by the infant's mother 
without criminal liability, which is commonly known as this state's Safe Haven Law. 
• The SBE and DOE will be able to develop guidelines and educational materials required by 
the proposed legislation within existing resources and during the normal course of business. 
• Schools will not be required to purchase or update classroom materials and will be able to 
include instruction on this state’s Safe Haven Law utilizing free and available resources 
during the normal course of instruction of a family life curriculum.  
• Any fiscal impact to state or local government is estimated to be not significant.
