Specifies that the privileges and immunities afforded to this state, state entities, and state officials under state or federal law are not waived or abrogated for purposes of such actions, and that justiciability doctrines applicable to state courts are not expanded. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 1-3-121, a cause of action shall exist for any affected person who seeks declaratory or injunctive relief in any action brought regarding the legality or constitutionality of a governmental action. A cause of action shall not exist in such circumstances to seek damages. The proposed legislation requires such actions to be brought in state court. • The exact number of relevant actions brought per year is unknown. • Based on information provided by the Administrative Office of the Courts, any resulting increase in caseloads to state trial courts can be absorbed within existing judicial resources. Any decrease in caseload to any federal or local courts is estimated to be not significant. • Any fiscal impact to state or local government is estimated to be not significant.
