SB 767 – HB 1146 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 8, 2025 Fiscal Analyst: Elizabeth Bransford | Email: elizabeth.bransford@capitol.tn.gov | Phone: 615-741-2564 SB 767 – HB 1146 SUMMARY OF BILL: Requires an ordinance or policy adopted by a political subdivision in its application for a designation as a broadband ready community to contain a provision certifying all applications related to a project will be reviewed and either approved or denied within 30 calendar days, rather than 30 business days, after the application is submitted. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 4-3-709(a): o A political subdivision may apply to the Department of Economic and Community Development (ECD) for a “broadband ready community” designation pursuant to the guidelines established by ECD; o The political subdivision applicant must adopt an efficient and streamlined ordinance or policy for reviewing and issuing permits relative to broadband services; o The ordinance or policy must contain a provision that all permit applications related to a project will be reviewed and either approved or denied within 30 business days after an application is submitted. • The proposed legislation modifies the date in which the political subdivision must review and approve or deny permit applications from 30 business days to 30 calendar days. • Reducing the amount of time each designated political subdivision must review and approve or deny an application for permits will not significantly impact state or local operations, expenses, or revenue.
