SUMMARY OF BILL:    Deletes the provision that is it the responsibility of each parent or 
legal guardian to ensure that their children receive the vaccines as are recommended by guidelines of 
the Center for Disease Control and the American Academy of Pediatrics. 
 
 
FISCAL IMPACT: 
NOT SIGNIFICANT  
  
 Assumptions: 
 
• Tennessee Code Annotated § 37-10-401(a) currently recommends the following 
immunizations, among others, within the first two years of a child’s life: diphtheria-tetanus-
pertussis, polio, measles-mumps-rubella, Hemophilus influenzae type b conjugate vaccines, 
hepatitis b vaccine, pneumococcal vaccine, influenza vaccine, and varicella. 
• The proposed legislation still allows parents or guardians to provide the vaccines to their 
children and does not limit the availability of such vaccines to individuals. 
• The proposed legislation will not result in any fiscal or operational impact to the 
Department of Children’s Services. 
• The Department of Health (DOH) currently authorizes certain medical and religious 
exemptions from immunization requirements. 
• The proposed legislation will not impact DOH rules regarding immunization requirements 
for child care through 12
th
 grade, or the Tennessee Immunization Information System 
maintained by DOH. 
• Based on information previously provided by the Department of Education, the proposed 
legislation will not jeopardize federal education funding or have a significant impact on the 
department’s policies and procedures. 
• Any fiscal impact from removing the provision that it is a parent’s responsibility to ensure 
that a child receives certain vaccines is estimated to be not significant.
