SUMMARY OF BILL:    Requires an official who is employed or contracted by the federal, 
state, or local government within this state, or an agency or department thereof, to obtain a search 
warrant that identifies the person or property that is the subject of a search prior to entering private 
property to conduct a search. Establishes that such an officer is not required to obtain a search 
warrant prior to entering private property to conduct a search if a judicially recognized exception to 
the warrant requirement exists at the time of the search. Creates a Class C misdemeanor offense for 
an officer to knowingly fail to obtain a search warrant when a search warrant is required. 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT 
  
 Assumptions: 
 
• The proposed provisions are not estimated to represent a significant departure from the 
current practice of law enforcement officers when executing a search on private property. It 
is assumed that such officers can comply with the requirements in the normal course of 
their duties.  
• A person convicted of a Class C misdemeanor is assumed to serve an average of zero days 
incarcerated.  
• The legislation is not estimated to result in a significant number of Class C misdemeanor 
convictions for noncompliance. Any increase in local expenditures related to incarceration 
is estimated to be not significant.  
• Based on the Fiscal Review Committee’s 2008 study and the Administrative Office of the 
Courts’ 2012 study on collection of court costs, fees, and fines, collection in criminal cases 
is insignificant; therefore, any increase in local revenue from fines is estimated to be not 
significant.  
• The courts can issue such warrants in the normal course of business within existing 
resources.  
• Any fiscal impact to state or local government is estimated to be not significant.
