SB 1112 - HB 1085

SUMMARY OF BILL: Prohibits a local board of education or public charter school
governing body from removing a material from a library collection for the sole reason that the
material is religious.

FISCAL IMPACT:

NOT SIGNIFICANT

 Assumptions:

• Pursuant to Tenn. Code Ann. § 49-6-3803(a), materials in a school library collection are
required to be suitable for the age and maturity levels of the students who may access the
materials and must be suitable for, and consistent with, the educational mission of the
school.
• Pursuant to Tenn. Code Ann. § 49-6-3803(d) through (g), each local board of education and
public charter school governing body is required to adopt a policy for developing and
reviewing a school’s library collections, and to establish procedures for the removal of
materials found to be inappropriate from a library collection.
• Local boards of education and public charter school governing bodies will be able to update
their policies pursuant to the removal of materials from a school library collection within
existing resources such that any fiscal impact is estimated to be not significant.
