SUMMARY OF BILL:    Deletes the offense of criminal abortion.  Establishes the following 
as fundamental individual rights: (1) the right to make decisions about a person’s own reproductive 
health care, including the right to use or refuse contraception, and; (2) the right of a pregnant 
woman to have an abortion before viability of the fetus, or when necessary to protect the life or 
health of the woman. Prohibits any state or local governmental entity from denying, restricting, 
interfering with, or discriminating against these rights. Declares that a fertilized egg, embryo, or fetus 
does not have independent or derivative rights under the laws of this state 
 
 
FISCAL IMPACT: 
 
NOT SIGNIFICANT 
  
 Assumptions: 
 
• Pursuant to Tenn. Code Ann. § 39-15-213(b), criminal abortion is a Class C felony. 
• The proposed legislation deletes the offense of criminal abortion. 
• Based on information provided by the Department of Correction, there have been zero 
admissions for the Class C felony offense of criminal abortion. 
• Removing the offense will therefore not result in a significant impact to state incarceration 
expenditures, or the caseloads of state or local courts.  
• Any fiscal impact to state or local government related to the individual rights or restrictions 
on governmental entities established in this legislation is estimated to be not significant.
