SB 1235 - HB 1237 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 21, 2025 Fiscal Analyst: Laura Moore | Email: laura.moore@capitol.tn.gov | Phone: 615-741-2564 SB 1235 - HB 1237 SUMMARY OF BILL: Prohibits the regulatory board of a state entity, including a health- related regulatory board, from operating under race-based policies pertaining to the composition of such entities, including policies on affirmative action, racial preferences, or racial quotas. Prohibits a board from using a person's race, color, ethnicity, or national origin to determine the person's participation as a member of the board. Establishes a private cause of action against a board, its officers, employees and agents for such violations. Removes requirement that appointing authorities strive to ensure certain boards and commissions are represented by members of racial minorities. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • The state regulatory boards and the health-related regulatory boards can comply with the provisions of the proposed legislation within existing resources. • The proposed legislation does not change the total number of members for any board. Each board will continue to meet at the same frequency. • It is assumed that all boards will comply with the requirements of this legislation. Any fiscal impact to the boards is considered to be not significant. • Any additional workload on the court system can be accommodated within existing resources.
