SUMMARY OF BILL:    Includes students, along with teachers and school employees of a 
public school and local education agency (LEA), to the categories of individuals who are not 
required to use a preferred pronoun, and for whom a preferred pronoun can be disregarded, if the 
pronoun is inconsistent with the person’s biological sex. Extends civil liability immunity for causes 
of action arising under state law for the use of preferred pronouns as authorized by the proposed 
legislation, to teachers, school employees, students, public schools, and LEAs.  
 
 
FISCAL IMPACT:

 Assumptions: 
 
• As a condition of receipt of federal funds, the Department of Education (DOE) and each 
LEA must sign assurances that they will comply with federal civil rights law, such as Title 
IX.   
• Title IX of the Education Amendments of 1972 is a federal law that prohibits discrimination 
“on the basis of sex” in federally funded education programs and activities.   
• On April 19, 2024, the United States Department of Education released a final rule under 
Title IX which altered key principles of the 2020 rule. The 2024 rule expanded the scope of 
discriminatory conduct prohibited by Title IX and increased schools’ responsibility to 
prevent and respond to Title IX complaints. It became effective on August 1, 2024. 
• On January 9, 2025, a federal district court vacated a set of Title IX regulations and 
established that Title IX does not protect students from discrimination on the basis of 
gender identity and sexual orientation. Therefore, the proposed legislation is not expected 
to be in violation of federal law or rule or to jeopardize federal funding. 
• Any impact to state or local government is estimated to be not significant.
