SB 1336 - HB 1383 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly February 15, 2025 Fiscal Analyst: Christine Drescher | Email: christine.drescher@capitol.tn.gov | Phone: 615-741-2564 SB 1336 - HB 1383 SUMMARY OF BILL: Requires elections for county boards of education be held at the same time and on the same election cycle as elections for members of the local legislative body for the county. Specifies that members of county boards of education must have the same staggered terms and term limits as members of the local legislative body for the county. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Tennessee Code Annotated § 49-2-201(a)(1) currently requires board of education members’ terms to be staggered and that each elected member is elected for a term of four years. • Pursuant to Tenn. Code Ann. § 49-2-201(d)(1)(A)-(C): o Primary elections for school boards in which candidates nominated for school boards are to appear on the regular August election ballot are to be held on the first Tuesday in May before the August election and in years in which an election for President is held the primary election for school board members is to be held on the same day as the presidential preference primary; o Primary elections in which candidates nominated for school board are to appear on the regular November election ballot are held concurrently with the regular August election; and o Primary elections in which candidates nominated for school board are to appear on a ballot other than the regular August or regular November election ballot may be held on the first Tuesday in the third month before the election. • Although not specified in the proposed legislation, it is assumed that individuals who are current members of a county board of education, but have served longer than a term limit would allow, are allowed to finish out the remainder of their current term, resulting in no increase in local expenditures associated with a special election. • The proposed legislation will not result in any significant decrease in local expenditures associated with elections as a result of ensuring county boards of education and local legislative bodies have simultaneous elections. • It is assumed that the proposed term limits and restrictions on board members will not result in a significant reduction in the number of candidates seeking to serve on county boards of education.
