This is problematic for those who have pre-purchased plots in a perpetual care cemetery and paid into the perpetual care funds overseen by the Department of Banking. C.S.H.B. 1031 specifies that the perpetual care obligation of a corporation operating a perpetual care cemetery includes the maintenance, repair, and care of roads on cemetery property. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
