RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.    SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 487.351, Government Code, by adding Subsection (d), as follows:   (d) Authorizes an applicant for a grant, loan, or award under a community development block grant program to appeal a decision of the executive director of the Office of Rural Community Affairs (ORCA) by filing an appeal with the ORCA board (board). Requires the board to hold a hearing on the appeal and render a decision.   SECTION 2. (a) Abolishes the state community development review committee.   (b) Repealer: Section 487.353 (State Community Development Review Committee), Government Code.   SECTION 3. Effective date: upon passage or September 1, 2009.

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1079 amends current law relating to the appellate process for the community development block grant program.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. 

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 487.351, Government Code, by adding Subsection (d), as follows:

 

(d) Authorizes an applicant for a grant, loan, or award under a community development block grant program to appeal a decision of the executive director of the Office of Rural Community Affairs (ORCA) by filing an appeal with the ORCA board (board). Requires the board to hold a hearing on the appeal and render a decision.

 

SECTION 2. (a) Abolishes the state community development review committee.

 

(b) Repealer: Section 487.353 (State Community Development Review Committee), Government Code.

 

SECTION 3. Effective date: upon passage or September 1, 2009.
