(Nelson)  Health & Human Services  4/28/2009  Engrossed     AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   Current law requires all nursing homes and related facilities to post on their premises information regarding the facility's compliance status. The notice must be onsite and readily available to residents, employees, and visitors. The Department of Aging and Disability Services (DADS) voluntarily posts this information on the DADS website.   H.B. 1081 requires DADS to post and update compliance history information regarding housing and related facilities on the DADS website.   [Note: While the statutory reference in this bill is to the Texas Department of Human Services (DHS), the following amendments affect the Department of Aging and Disability Services, as the successor agency to DHS.]   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 242.042, Health and Safety Code, by adding Subsection (e), to require the Department of Health Services (DHS) to post detailed compliance information regarding each institution licensed by DHS, including the information an institution is required to make accessible by Subsection (c), on DHS' website. Requires DHS to update the website once a month to provide the most current compliance information regarding each institution.   SECTION 2. Effective date: September 1, 2009.
