Fiscal Analysis

The bill would amend the Transportation Code to require that a driver's license, personal identification certificate, commercial driver's license and commercial driver learner's permit issued by the Department of Public Safety (DPS) to a person registered under Chapter 62, Code of Criminal Procedure state that the holder is a registered sex offender. The bill would authorize DPS to charge a fee to persons whose license would require the additional information. The bill would take effect September 1, 2009 and apply only to licenses and identification certificates issued or renewed on or after the effective date.

Methodology

The bill would require modification to add a new field to the driver license system and associated programs to add a new field to recognize registered sex offender (RSO) records. Additionally, the card production system would require modifications to recognize and print the RSO designation on the back of the card. This analysis assumes that implementing the provisions of the bill could be reasonably absorbed within current agency resources without causing a significant fiscal impact. The bill would allow DPS to collect an additional fee to implement the requirements. There are currently 62,000 registered sex offenders, of which 43,000 meet the requirements indicated by the bill. DPS indicates that it would add $2.00 to the current $20.00 registrant fee. The additional fee would generate approximately $14,333 annually ($2.00 fee x 43,000 registrants divided by 6 years).
