Currently, the membership of the board of managers for certain rural emergency management districts, or 9-1-1 districts, consists of two individuals appointed by the county commissioners court, two individuals appointed by the municipalities within the district, one individual appointed by a volunteer fire department within the district, and one individual appointed by the principal service supplier. H.B. 1187 requires a peace officer appointed by the county sheriff to be included on the board of managers of certain emergency communication districts. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 772.306, Health and Safety Code, by adding Subsection (o), as follows: (o) Provides that in an emergency communication district (district) subject to this subchapter located entirely in a county with a population of less than 30,000, the board of managers of a district (board) consists of the appropriate members listed in Subsection (c) (relating to the composition of the board) and a peace officer licensed under Chapter 1701 (Law Enforcement Officers), Occupations Code, appointed by the county sheriff. SECTION 2. Requires the sheriff of a county to which Section 772.306(o), Health and Safety Code, as added by this Act, applies to appoint a peace officer to the board as required by Section 772.306(o) as soon as practicable after the effective date of this Act. SECTION 3. Effective date: upon passage or September 1, 2009.
