A BILL TO BE ENTITLED
AN ACT
relating to the provision of academic tutoring for students at an
academically unacceptable public school campus before the campus is
reconstituted.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.1324, Education Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1) Notwithstanding Subsection (a), a campus may not be
reconstituted in accordance with an order of the commissioner under
that subsection unless academic tutoring for students is made
available at the campus at state expense during the school year
preceding the school year in which the campus is anticipated to open
as a reconstituted campus.
SECTION 2. This Act applies only to a campus subject to an
order of the commissioner of education under Section 39.1324(a),
Education Code, that is issued on or after the effective date of
this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
