A BILL TO BE ENTITLED
AN ACT
relating to the regulation by the Railroad Commission of Texas of
the transportation of drilling mud; providing an administrative
penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 91, Natural Resources
Code, is amended by adding Section 91.118 to read as follows:
Sec. 91.118. REQUIREMENTS FOR TRANSPORTING DRILLING MUD.
(a) The commission by rule shall require a person who operates a
motor vehicle that is used to transport drilling mud to equip and
maintain the vehicle in a manner that prevents the drilling mud from
escaping from, or being deposited on a public road or highway by,
the vehicle.
(b) The commission may assess an administrative penalty as
provided by Sections 81.0531-81.0534 against a person who violates
this section or a rule adopted under this section.
SECTION 2. This Act takes effect September 1, 2009.
