O'Brien, Director, Legislative Budget Board IN RE:HB1424 by Leibowitz (Relating to the procedure for the disannexation of territory from a municipality.), As Introduced No fiscal implication to the State is anticipated. The bill would amend the Local Government Code to require the governing body of a municipality to certify the validity of a petition submitted seeking disannexation of an area, and upon certifying the petition is valid, to disannex the area within 60 days after the date of certification unless the municipality brings a cause of action to seek keeping the area annexed. The municipality or the petitioners would be authorized to request a factual determination in a proceeding to be made by a jury. Local Government Impact No significant fiscal implication to units of local government is anticipated as a result of changes in procedures.
