O'Brien, Director, Legislative Budget Board IN RE:HB1425 by Lewis (Relating to the determination of the population of a county required to develop a juvenile justice alternative education program.), As Introduced No significant fiscal implication to the State is anticipated. Section 1 of the bill would amend Section 37.011, Education Code, by adding Subsection (a-1) to stipulate that the county's population would be determined by the 2000 Federal Census for the purpose of determining whether a county's population was large enough to require the development of a Juvenile Justice Alternative Education Program (JJAEP). Section 2 of the bill would require a juvenile court to modify the conditions of probation or deferred prosecution for a youth ordered to attend a JJAEP in a county that was not required to operate a JJAEP if the county discontinues operation of the JJAEP. Section 3 of the bill would make the bill apply beginning with the 20092010 school year. Section 4 of the bill would make the bill effective immediately if passed with the necessary votes, or September 1, 2009.
