O'Brien, Director, Legislative Budget Board     IN RE:HB1425 by Lewis (Relating to the determination of the population of a county required to develop a juvenile justice alternative education program.), As Introduced    No significant fiscal implication to the State is anticipated.    Section 1 of the bill would amend Section 37.011, Education Code, by adding Subsection (a-1) to stipulate that the county's population would be determined by the 2000 Federal Census for the purpose of determining whether a county's population was large enough to require the development of a Juvenile Justice Alternative Education Program (JJAEP). Section 2 of the bill would require a juvenile court to modify the conditions of probation or deferred prosecution for a youth ordered to attend a JJAEP in a county that was not required to operate a JJAEP if the county discontinues operation of the JJAEP. Section 3 of the bill would make the bill apply beginning with the 20092010 school year. Section 4 of the bill would make the bill effective immediately if passed with the necessary votes, or September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
