                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION            May 4, 2009      TO: Honorable Leticia Van de Putte, Chair, Senate Committee on Veteran Affairs & Military Installations      FROM: John S. O'Brien, Director, Legislative Budget Board     IN RE:HB1466 by Swinford (Relating to the theft of a military grave marker.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code to include theft of a military grave marker as punishable as a state jail felony.  The bill would take effect immediately if it receives a vote of two-thirds of all the members of each house.  If it does not receive the necessary vote for immediate effect, it would take effect on September 1, 2009.  It is assumed the number of persons convicted under this statute would not result in a significant impact on programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
