No. 15 A BILL TO BE ENTITLED AN ACT relating to the participation of certain metropolitan planning organization policy board members in votes of the board related to certain toll projects. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 371, Transportation Code, as added by Chapter 103 (H.B. 570), Acts of the 80th Legislature, Regular Session, 2007, is amended by adding Section 371.002 to read as follows: Sec. 371.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL OF TOLL PROJECTS. A member of the policy board of a metropolitan planning organization may not participate in a vote of the board to approve the construction of a new toll project or the conversion of a nontolled project to a toll project unless the member is an elected official. SECTION 2. Subchapter A, Chapter 372, Transportation Code, is amended by adding Section 372.002 to read as follows: Sec. 372.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL OF TOLL PROJECTS. A member of the policy board of a metropolitan planning organization may not participate in a vote of the board to approve the construction of a new toll project or the conversion of a nontolled project to a toll project unless the member is an elected official. SECTION 3. (a) Section 1 of this Act takes effect only if the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes does not become law. If the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes becomes law, Section 1 of this Act has no effect. (b) Section 2 of this Act takes effect only if the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes becomes law. If the Act of the 81st Legislature, Regular Session, 2009, relating to nonsubstantive additions to and corrections in existing codes does not become law, Section 2 of this Act has no effect. SECTION 4. This Act takes effect September 1, 2009.
