The bill would amend the Alcoholic Beverage Code by adding Section 109.5305 to exempt facilities owned by a municipality or county from certain provisions and any rules adopted by the Texas Alcoholic Beverage Commission (TABC) prohibiting subterfuge ownership of a license or permit or the premises covered by a license or permit. The bill would take effect September 1, 2009. TABC states the bill would have no fiscal impact to the agency. Local Government Impact No fiscal implication to units of local government is anticipated.
