(Jackson) Health & Human Services 5/2/2009 Engrossed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT More babies between the age of one month and one year die from sudden infant death syndrome (SIDS) than any other cause. To increase awareness and educate caregivers about SIDS, the Department of State Health Services (DSHS) has developed a fact sheet entitled "Safer Sleep for Babies" that offers precautions to help prevent sleep-related infant deaths. Section 161.501 (Resource Pamphlet), Health and Safety Code, mandates that a resource pamphlet published by DSHS, "Information for Parents of Newborns," be provided to parents of newborn children. The Southwest SIDS Research Institute believes that this resource pamphlet would serve as a practical and beneficial vehicle for educating parents of newborns about SIDS and how to prevent their child from becoming a victim. This bill requires that information regarding SIDS, including current recommendations for infant sleeping conditions to lower the risk of SIDS, be added to the resource pamphlet mandated by law to be provided to the parent of an infant. H.B. 1510 relates to including information on sudden infant death syndrome in a resource pamphlet for parents of newborn children. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 161.501(a), Health and Safety Code, as follows: (a) Requires a hospital, birthing center, physician, nurse midwife, or midwife who provides prenatal care to a pregnant woman during gestation or a delivery of an infant to provide the woman and the father of the infant, if possible, or another adult caregiver for the infant, with a resource pamphlet that includes certain information, including information regarding sudden infant death syndrome, including current recommendations for infant sleeping conditions to lower the risk of sudden infant death syndrome. SECTION 2. Requires the Department of State Health Services (DSHS), not later than January 1, 2010, to update the resource pamphlet on DSHS's website to include the information about sudden infant death syndrome required by Section 161.501, Health and Safety Code, as amended by this Act. SECTION 3. Provides that a hospital, birthing center, physician, nurse midwife, or midwife who provides prenatal care to a pregnant woman during gestation or at delivery of an infant is not required to provide the updated brochure containing the information about sudden infant death syndrome required by Section 161.501, Health and Safety Code, as amended by this Act, before March 1, 2010.
