O'Brien, Director, Legislative Budget Board IN RE:HB155 by Gutierrez (Relating to access to rivers and riverbeds for individuals with physical disabilities.), Committee Report 1st House, Substituted No fiscal implication to the State is anticipated. The bill would amend the Parks and Wildlife Code relating to access to rivers and riverbeds for individuals with physical disabilities. TPWD indicates Section 90.002 of the Parks and Wildlife Code generally prohibits driving a motor vehicle in or on a protected freshwater area. The bill would add a new exception to the list of exceptions in Section 90.003 to include individuals with a physical disability, as defined, under certain conditions. To the extent the bill would modify provisions relating to river and riverbed access, no fiscal implication to the State is anticipated. The bill would take effect September 1, 2009. Local Government Impact No fiscal implication to units of local government is anticipated.
