A BILL TO BE ENTITLED
AN ACT
relating to notification of certain members of the legislature if a
school district fails to file its annual audit report in a timely
manner.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 44.008, Education Code, is amended by
adding Subsection (d-1) to read as follows:
(d-1) If a school district has not filed a copy of the school
district's annual audit report in compliance with Subsection (d) by
the 60th day after the date specified by that subsection, the agency
shall promptly report the school district's failure to comply to
each member of the legislature whose district contains any portion
of the territory included in the school district.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
