LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION April 1, 2009 TO: Honorable Garnet Coleman, Chair, House Committee on County Affairs FROM: John S. O'Brien, Director, Legislative Budget Board IN RE:HB1632 by Christian (Relating to the exemption from certain construction requirements for volunteer fire departments in certain counties.), As Introduced No fiscal implication to the State is anticipated. The bill would amend the Occupations Code to exempt from requirements related to construction of certain public works a building or other facility that is occupied exclusively by a volunteer fire department in a county with a population of 80,000 or less and that is not routinely used by the public. The bill would in effect allow construction of certain public works in smaller counties by the state or a political subdivision without having to have engineering plans, specifications, and estimates prepared by an engineer and without having the engineering construction performed under the direct supervision of an engineer. This exemption would provide a savings in the costs of a construction project. It is not anticipated that the state would construct a public work affecting a building occupied by a volunteer fire department; therefore, the fiscal implications are expected to affect local government entities only. Local Government Impact No significant fiscal implication to units of local government is anticipated.
