(Duncan)  State Affairs  5/20/2009  Engrossed     AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   H.B. 1657 amends current law relating to workers' compensation insurance coverage regarding certain contractors.    RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Sections 406.121(1) and (5), Labor Code, to redefine "general contractor" and "subcontractor."    SECTION 2. Amends Subchapter F, Chapter 406, Labor Code, by adding Section 406.128, as follows:   Sec. 406.128. APPLICATION TO CERTAIN PREMISES OWNERS. (a) Defines "small business."    (b) Authorizes a premises owner who is a homeowner, a general small business, or a small business engaged in agriculture, notwithstanding any other provision of this subchapter, to operate as a general contractor for purposes of this chapter in procuring the performance of work or a service on the premises of that premises owner.   SECTION 3. Effective date: upon passage or September 1, 2009.

H.B. 1657 amends current law relating to workers' compensation insurance coverage regarding certain contractors. 

 

RULEMAKING AUTHORITY

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Sections 406.121(1) and (5), Labor Code, to redefine "general contractor" and "subcontractor." 

 

SECTION 2. Amends Subchapter F, Chapter 406, Labor Code, by adding Section 406.128, as follows:

 

Sec. 406.128. APPLICATION TO CERTAIN PREMISES OWNERS. (a) Defines "small business."
