A BILL TO BE ENTITLED
AN ACT
relating to an exemption for groundwater used for certain purposes
from production fees assessed by the Upper Trinity Groundwater
Conservation District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 8830.152, Special District Local Laws
Code, is amended by adding Subsection (f) to read as follows:
(f) The district shall exempt from the payment of production
fees established under this section any groundwater used for
firefighting purposes by:
(1) an emergency services district; or
(2) a fire department.
SECTION 2. Section 8830.152(f), Special District Local Laws
Code, as added by this Act, applies only to the assessment of a
groundwater production fee by the Upper Trinity Groundwater
Conservation District on or after the effective date of this Act.
The assessment of a groundwater production fee by the Upper Trinity
Groundwater Conservation District before the effective date of this
Act is governed by the law in effect on the date the fee was
assessed, and that law is continued in effect for that purpose.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
