 A BILL TO BE ENTITLED
 AN ACT
 relating to accountability for gifted and talented programs
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Chapter 39, Education Code, is amended by adding
 Section 39.117, to read as follows:
 Section 39.117.  GIFTED AND TALENTED STANDARDS.  The
 commissioner shall adopt standards for the evaluation of gifted and
 talented programs.  A school that uses the Texas Performance
 Standards Project or another program approved by the commissioner
 that meets the requirements of the Texas state plan for the
 education of gifted and talented students under section 29.123 and
 receives a satisfactory rating under the standards set by the
 commissioner shall not be subject to the limitation under 42.156
 (c) for the following two school years.  If a district fails to
 receive a satisfactory rating for two consecutive school years, it
 shall be subject to the limitation under 42.156 (c) until the year
 following a satisfactory rating.
 Section 2. Section 42.156 (c) is amended to read as follows:
 (c) Except as provided in Section 39.117, not more than five
 percent of a district's students in average daily attendance are
 eligible for funding under this section.
 Section 3. The commissioner shall adopt standards for the
 evaluation of gifted and talented programs for the evaluation of
 gifted and talented programs no later than September 1, 2010.
 Section 4. This Act takes effect September 1, 2009.
