O'Brien, Director, Legislative Budget Board     IN RE:HB1804 by Hughes (Relating to service of process for delinquent taxes on a nonresident.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Civil Practice and Remedies Code related to delinquent taxes to apply regardless of whether the defendant has resided in Texas.  The bill would require duplicate copies of the process issued by the clerk of the court to be served on the Secretary of State (SOS).  SOS would be required to mail a copy of the process via certified mail, return receipt requested, with the postage prepaid to the nonresident and certify to the court that SOS has complied.  SOS and the Office of Court Administration indicate that any increases in costs associated with this bill could be absorbed within existing agency resources.  The bill would be effective September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
