O'Brien, Director, Legislative Budget Board     IN RE:HB1868 by Anchia (Relating to distribution of sexual barrier protection devices to inmates and state jail defendants confined in facilities operated by or under contract with the Texas Department of Criminal Justice and the testing of certain inmates for HIV.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Government Code by requiring the Texas Department of Criminal Justice (TDCJ) to annually test an offender for human immunodeficiency virus (HIV) who does not have a record of a positive test result and who has not undergone testing during the last calendar year. The bill would require TDCJ to adopt a policy that provides for the distribution of condoms through a health care provider at each facility and a nonprofit or public health care agency. TDCJ has estimated that costs associated with annual HIV tests would be approximately $828,000 (approximately 90,000 HIV tests per year x $9.20 per test). The Texas Department of Criminal Justice has determined that the cost of implementing the bill would not be significant.
