O'Brien, Director, Legislative Budget Board     IN RE:HB1946 by Bonnen (Relating to the creation of the Brazoria County Municipal Utility District No. 64; providing authority to impose a tax and issue bonds; granting a limited power of eminent domain.), As Engrossed    No significant fiscal implication to the State is anticipated.  As part of the creation of the Brazoria County Municipal Utility District No. 64, the bill would authorize the owner or owners of a majority of the assessed value of the real property in the district to submit a petition to the Texas Commission on Environmental Quality (TCEQ) requesting the agency to appoint temporary directors of the district. If the district uses its road project authority and if the state will maintain and operate the road, the Texas Transportation Commission (TTC) would be required to approve the plans and specifications of the road project. Any costs associated with appointing temporary directors can be absorbed within TCEQ's existing resources. Any costs associated with reviewing and approving road project plans could be absorbed within TTC's existing resources.  Local Government Impact Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
