The bill would establish that the Council may make investments as permitted under Section 5(f), Article VII, Texas Constitution and would specifically prohibit investments in real estate. The bill would require the State Auditor's Office (SAO) to perform an annual financial audit of the Permanent School Fund and would allow the SAO to contract with an accounting firm for this purpose. The bill would require annual reports to the Governor and the Legislature of the Council's investment and fiduciary practices and policies. The bill would take effect on January 1, 2010 contingent on approval of the associated constitutional amendment.
