The bill would allow the holder of a brewer's permit or manufacturer's license, whose combined annual production of ale and beer does not exceed 250,000 barrels, to conduct tours of the brewery or manufacturers premises and charge an admission fee for the tour. The bill would also allow the brewer or manufacturer to give to tour participants, without additional charge, ale and/or beer in unbroken packages for off-premises consumption, not to exceed 48 12-ounce bottles of ale and/or beer in a single day. The Comptroller of Public Accounts (CPA) indicates that currently The Texas Alcoholic Beverage Commission (TABC) permits 14 brewers and licenses 13 manufacturers, of which fewer than 10 would be affected by this bill. Any sales made by those businesses to ultimate consumers would not have a significant impact on sales or on the revenue from taxes levied on those products. The bill would take effect upon two-thirds vote in each house. Otherwise, it would take effect on September 1, 2009.
