 A BILL TO BE ENTITLED
 AN ACT
 relating to the confidentiality under the public information law of
 certain name and address information provided to a governmental
 body.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter C, Chapter 552, Government Code, is
 amended by adding Section 552.1375 to read as follows:
 Sec. 552.1375.  CONFIDENTIALITY OF CERTAIN NAME AND ADDRESS
 INFORMATION. (a) Except as otherwise provided by this section, the
 name and physical address of an individual who provides that
 information to a governmental body in connection with a
 communication to the governmental body or for the purpose of
 receiving a subsequent communication from the governmental body is
 confidential and not subject to disclosure under this chapter.
 (b)  Confidential information described by Subsection (a)
 may be disclosed if the individual affirmatively consents to its
 release.
 (c)  Subsection (a) does not apply to the name or address of
 an individual that was provided for a purpose or in a manner
 described by Section 552.137(c).
 (d)  Subsection (a) does not prevent a governmental body from
 disclosing confidential information described by Subsection (a)
 for any reason to another governmental body or to a federal agency.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
