                    BILL ANALYSIS             H.B. 2113     By: Walle     Urban Affairs     Committee Report (Unamended)             BACKGROUND AND PURPOSE   The tragic events of September 11, 2001, took the lives of many brave fire fighters and peace officers, and it is important to remember their sacrifice.    H.B. 2113 offers fire fighters and peace officers a holiday on September 11 by using either a holiday or a vacation day.      RULEMAKING AUTHORITY   It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.      ANALYSIS   H.B. 2113 amends the Local Government Code to entitle a fire fighter or police officer to a paid day off from working on September 11 of each year if: the fire fighter or police officer agrees to or is required to work on a holiday during the same fiscal year and chooses to take that holiday on September 11; or the fire fighter or police officer chooses to use a vacation day, a day in lieu of a vacation day or holiday, or accumulated compensatory leave to take a paid day off on September 11; and the fire fighter's or police officer's supervisor does not require the fire fighter or police officer to work that day to maintain minimum staffing necessary for public safety.      EFFECTIVE DATE   September 1, 2009.
