No. 2161 A BILL TO BE ENTITLED AN ACT relating to the issuance of a personal identification certificate to present or former inmates of the Texas Department of Criminal Justice. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 501, Government Code, is amended by adding Section 501.0165 to read as follows: Sec. 501.0165. IDENTIFICATION CERTIFICATE. (a) Not later than the 90th day before the date an inmate is transferred to pre-parole status, the department shall request a personal identification certificate from the Texas Department of Public Safety for the inmate if the inmate does not possess a valid driver's license or personal identification certificate. (b) The department shall send a certified copy of the offender identification card or similar form of identification to the Texas Department of Public Safety with a current photograph of the inmate. (c) On receipt of the personal identification certificate from the Texas Department of Public Safety, the department shall verify the information on the certificate and request any necessary change. (d) The department shall pay any fee associated with obtaining the personal identification certificate out of funds appropriated to the department for the project for reintegration of offenders under Chapter 306, Labor Code. SECTION 2. Section 521.101(d), Transportation Code, is amended to read as follows: (d) The department may require each applicant for an original, renewal, or duplicate personal identification certificate to furnish to the department the information required by Section 521.142. The department must accept as satisfactory proof of identity under this section an offender identification card or similar form of identification issued to an inmate by the Texas Department of Criminal Justice. SECTION 3. This Act takes effect September 1, 2009.
